Hahow 使用者條款
本使用者條款（以下稱「本條款」）適用於所有位於及連結於 hahow.in 網域之網站及 Hahow 所有之行動裝置應用程式（以下稱「Hahow」「我們」「我們的」），Hahow 為思哈股份有限公司、子公司及其關係企業之財產（以下稱「Hahow 集團」）。
同意條款
不論個別的使用者其物理位置於何處，本條款適用於所有連結至 Hahow 之會員或訪客（以下合稱「使用者」、「您」），透過持續使用 Hahow 提供之服務，即表示您已知悉且同意本條款，若您不同意本條款之部分或全部內容，您應立即停止使用 Hahow。另關於課程購買、購課後服務等，請參閱：Hahow 網際網路課程購買暨服務契約（以下簡稱購課合約），且於您使用 Hahow 前，亦請詳閱我們的隱私權政策。
若您有任何疑問，歡迎隨時直接聯繫我們的客服人員。關於募課提案者的權利及義務，我們將另以募資開課合約約定。
使用者未滿七歲，不得於 Hahow 「建立帳號」（如涉及購買課程等事項，請參考購課合約之約定），須由其法定代理人建立帳號。如使用者已滿七歲未滿十八歲，則其申請註冊成為會員前，需得其法定代理人同意，始得註冊及使用 Hahow 所提供的會員服務。使用者未滿十八歲，須保證其獲得法定代理人同意可使用 Hahow 提供的服務。當該使用者申請註冊成為會員，並繼續使用 Hahow 提供的服務時，則表示其法定代理人已經閱讀且知悉並同意本條款。
本條款更新
Hahow 集團在法律准許的範圍內，有權隨時修改、調整本條款中的任何條款內容。一旦 Hahow 集團對本條款內容進行修改或調整，Hahow 將會以公告形式發佈通知。任何修改或調整將於公布之時起生效。如果使用者在修改公布後，繼續使用 Hahow 所提供的服務，則表示同意遵守本條款之更動。因此，請使用者務必定期查閱本條款，以確保了解本條款的所有更動。如果使用者不同意 Hahow 對本條款之更動，請離開 Hahow 網站並立即停止使用 Hahow 服務，同時，會員應刪除個人檔案並註銷會員資格。Hahow 集團亦有權於下列違規情事發生時，刪除會員個人檔案並註銷會員資格。
會員帳號及密碼安全
無論使用者是訪客或會員，都可以瀏覽 Hahow 上的內容，但只有註冊成為會員之使用者始得購買線上課程並享受 Hahow 提供的各項服務。訪客可以很容易在 Hahow 上建立帳號，只要輸入 Email 或使用其個人已註冊之 Google 或 Facebook 帳號登入即可。
使用者不應使用任何與其個人真實資料無關之資訊建立其帳號名稱，包括但不限於使用模仿他人姓名或使用攻擊性的字眼、任何種族歧視的文字及任何會傷害、侵害他人權利之文字作為帳號名稱，如發生前開事項，Hahow 有權終止該帳號的服務。在僅建立帳號但尚未購買課程前（購買產品後，即依照購課合約之約定），應注意如下事項：會員應妥善保管其帳號及密碼，不應將其帳號及密碼轉讓或出借給他人使用，如會員發現其帳號遭他人非法使用，應立即通知 Hahow。因駭客行為或會員的保管疏忽導致帳號、密碼遭他人非法使用，Hahow 不負擔任何責任。
您有義務妥善保管帳戶、密碼及其他相關身分驗證資訊，並為此帳號登入系統後所進行之一切活動、行為負責，包括但不限於衍生之相關費用。
您同意在使用 Hahow 時遵循所有適用法律，且僅可基於合法目的使用本服務。以非經 Hahow 同意或指示之方式使用本服務或接觸系統，均應被嚴格禁止，Hahow 有權停止提供該使用者之服務。
隱私權政策
使用者提供的個人資料及 Hahow 集團保存與使用者相關之若干其它資料將受到中華民國法律和 Hahow 隱私權政策之規範。
使用規定和條約
任何經由 Hahow 服務上傳、張貼、發送電子郵件或任何其它方式傳送的文字、文件、影片、照片（包括使用者的照片）、圖片、聲音、音樂作品、創作作品或任何其他內容（以下簡稱「內容」），無論為公開或是私下傳送，均由內容提供者承擔責任。Hahow 針對任何會員上傳未經授權之內容，不負擔任何責任。
非經 Hahow 同意，使用者均不得下載、重製、公開傳輸、轉售、公開播放、分享或使用 Hahow 及 Hahow 上之課程。使用者違反前述規定，將負擔所有因此侵權行為而生之法律責任。
AI 線上交談服務
使用 AI 交談體驗時，其可讓 貴用戶提交提示、與線上電腦支援的聊天機器人交談，並在特定情況下產生文字內容 (以下稱「文字作品」，與影像作品合稱「作品」)。
貴用戶只能以合法、遵守本使用者條款且不會侵犯、嘗試侵犯或是違反 Hahow 集團、或任何第三方的方式使用本線上服務和產生的作品（這裡定義的「方式」，包括但不限於導致或嘗試導致 Hahow 線上服務產生內容的方法、目的和/或手段）。
由於本線上服務的本質，作品在使用者之間可能不是唯一的，本線上服務可能會為 Hahow 或其他使用者產生相同或類似的輸出。 其他使用者也可能會詢問類似的問題，並收到相同、類似或不同的回應。Hahow 並不保證本服務產出內容之真實性、正確性與重現性。
預購及課堂參與
Hahow 是一個群眾募課的預購平台。Hahow 允許部份會員提出課程並尋求其他會員的預購（預購者）。提出課程的這些會員即課程老師，而預購者或是購買課程之會員即為學生。
發票開立
Hahow 將於學生購買課程（不論預購或正式開課）後，開立並寄送發票予學生。
惟學生若於台灣以外地區購買課程，依中華民國稅法得免開發票。
第三方連結
Hahow 可能含有連結至 Hahow 以外之第三方網站，由於 Hahow 無法控制這些網站及資源，因此使用者在使用各該第三方網站前，需自行瞭解各該第三方網站之使用者條款及隱私權政策。
智慧財產權
Hahow 擁有 Hahow 及於 Hahow 上發表之所有內容（「網站內容」）之所有權利，所有權及一切因此所生之利益，包括所有著作權、專利、商業秘密，商標和其他智慧財產權。所有未被明確授權之權利將僅能由 Hahow 行使。
網站內容的所有材料和組合，包括但不限於檔案、課程、各式圖片、報告、課程介紹、講師介紹和常見問答均以 Hahow 為著作人。您對網站內容的所有材料和組合的使用均受本條款之約束。
Hahow 的設計或排版受著作權，外觀設計，商標，公平法和其他法律的保護，不得進行部分或全部之重製或模仿。未經 Hahow 集團明確授權，不得重製或轉發 Hahow 的商標，設計、聲音或圖像。
內容和其他合法權益
Hahow 集團並非所有上傳至 Hahow 內容之所有者。然而當會員及使用者發表、上傳、提交內容至 Hahow 網站或平台（包括但不限於留言區、課程評價、問題討論與作業成果區等），該會員即同意授與 Hahow 集團全球的、不可撤銷的、非專屬的、免費的授權可以重製、使用、發表、翻譯、公開展示、公開傳輸、公開傳播、改作前述內容至所有現在或未來的媒體平台。該會員同意前述使用將無須支付任何費用。
使用守則
使用 Hahow 的服務，即表示 貴用戶同意：
- 不從事對他人有害之活動，亦不嘗試建立或分享可能會用於騷擾、霸凌、謾罵、威脅或脅迫其他個人，或是造成個人、組織或社會傷害之內容。
- 不從事會違反他人隱私權之活動，亦不嘗試建立、分享可能會違反他人隱私權之內容，包含探查他人之私人資訊。
- 不從事詐騙、不實或誤導之活動，亦不嘗試建立或分享可能會誤導或欺騙他人之不實資訊。
- 不侵犯他人權利，亦不嘗試使用本線上服務侵犯他人之法律權利，包括智慧財產權。
- 不使用本服務建立或分享不當內容或資料。Hahow 不允許使用本線上服務建立或分享成人內容、暴力或血腥、仇恨內容、恐怖主義和暴力極端主義內容、美化暴力、兒童性剝削或虐待資料，或是其他具冒犯性的內容。
- 不進行任何非法活動。
終止服務
使用者同意 Hahow 集團有權可基於其判斷或任何原因，隨時以各樣理由終止或暫停會員使用 Hahow 之服務，包括但不限於該會員顯少使用服務、違反本條款等。而對已購課會員課程相關服務事項的終止，則另依購課合約之約定。
Hahow 集團於終止服務後，不論是否已通知，均得刪除該會員之帳號及內容，並可避免該使用者於未來連結至 Hahow 或使用 Hahow。
賠償
使用者擔保如 Hahow 集團及其管理階層、董事、員工、代理人及承包商因 a) 該使用者所發布或遞交之內容 b) 使用 Hahow c) 該使用者違反本條款及 d) 使用者侵犯第三人之任何權利，而產生之各樣主張、要求，從而受有損失、須負擔責任、損害賠償或支出（包括但不限於合理的律師費用），使用者同意賠償。
Hahow 集團對使用者關於 Hahow 的損害賠償責任，無論其原因為債務不履行、擔保責任、不當得利、侵權行為或其他損害賠償責任，均以現實發生之通常且直接損害為限。且賠償總額以該損害原因發生時，使用者所購買之有價服務金額為限（若無購買有價服務，則以新台幣 1,000 元整為限）。但因 Hahow 集團、其代表或其員工之故意或重大過失所致者除外。
資料備份
使用者同意隨時為資料備份，以防資料遺失，Hahow 不對任何內容遺失及使用者因此而受的相關損失承擔責任。
與廣告商進行之交易
使用者明白於 Hahow上所投放之廣告內容、行銷文字及商品說明等各種銷售資訊，均由各該廣告商、產品與服務供應商所刊登，Hahow 僅接受委託予以刊登，對內容並不做實質之審查或修改，請使用者自行謹慎斟酌判斷此等廣告之正確性與可信度。除有關法律法規有明文規定要求 Hahow 承擔責任以外，使用者因前述廣告而產生之交易遭受的任何的損失或損害，Hahow 均不予負責。
禁止商業行為
使用者同意於使用 Hahow 時將不會：a) 修改、重製、對於任何功能、程式進行還原工程 （reverse engineering）、反向組譯（disassemble）或任何企圖取得原始碼或內容之行為；b) 於上架之課程內容，包含任何商業或置入性行銷之內容，Hahow 有權自行認定並將違反規定之內容無條件下架或移除。
擔保與保證
Hahow 不保證以下事項：a) 本服務將符合使用者的特定要求；b) 於 Hahow 購買或取得之任何產品、服務、資訊或其它課程將符合使用者的期望。
Hahow 所提供之好幣 Money Point 所表彰之金額均已存入金融機構開立之信託帳戶。保證期間自出售日起算一年，保證期間屆滿後，Money Point 持有人仍得依法向 Hahow 請求提供服務。信託專戶係 Hahow 為保障消費者權益，依法以 Hahow 名義將消費者支付之全部預收款價金交付信託予金融機構，專款專用；所稱專用，係指供 Hahow 履行提供服務義務使用，信託之受益人原則上為 Hahow 而非消費者，惟如信託約定之情況發生時，Hahow 將與金融機構依信託契約之約定處理信託財產，以維消費者權益。（消費者查詢信託網址：https://www.cathaybk.com.tw/cathaybk/personal/wealth/trust/product/inquiry/）詳請可參閱 好幣 Money Point 專區。
一般性條款
本條款及使用者與 Hahow 之關係，均以中華民國法律為準據法。使用者與 Hahow 就本服務、本條款或其它有關事項發生的爭議，應以台灣台北地方法院為第一審管轄法院。倘本條款之部分規定因與中華民國法律抵觸而無效者，本條款其它規定仍應具有完整的效力及效果。本條款之標題僅供方便而設，不具任何法律或契約效果。

Hahow Terms of Service
These Terms of Service (the "Terms of Service") apply to all websites located at the hahow.in domain and all mobile applications owned by Hahow ("Hahow," "We," "Our"). Hahow is the property of Hahow Inc., its subsidiaries, and affiliates (collectively "Hahow Group").
User Agreement
Regardless of the physical location of the individual user, these Terms apply to all members or visitors ("users," "you") accessing Hahow. By continuing to use the services provided by Hahow, you are expressly acknowledging and accepting these Terms of Service. If you disagree with these terms and conditions or any part thereof, you must immediately cease using Hahow. For matters regarding course purchases and post-purchase services, please refer to the: Hahow Internet Course Purchase and Service Agreement (hereinafter referred to as the "Course Purchase Agreement"). Please also read our Privacy Policy before using Hahow.
If you have any questions, please feel free to contact our customer service personnel directly at any time. The rights and obligations of the crowdfunding proposal creators will be stated in a separate Crowdfunding Course Instructor Agreement.
Users under the age of seven are prohibited from "creating an account" on Hahow (for matters involving course purchases, please refer to the Course Purchase Agreement); accounts must be created by their legal guardian. If the user has reached the age of seven but is under the age of eighteen, the consent of a legal guardian is required before registering as a member and using the services provided by Hahow. Users under the age of eighteen must guarantee that they have obtained the consent of their legal guardian to use the services provided by Hahow. When the user applies to register as a member and continues to use the services provided by Hahow, it signifies that their legal guardian has read, understood, and agreed to these Terms.
Terms Update
Hahow Group reserves the right to modify or adjust any of the terms at any time, to the extent permitted by law. Once Hahow Group modifies or adjusts these Terms, Hahow will make an announcement of the update. Any changes will take effect from the time of the announcement. By continuing to use the services provided by Hahow after the modifications are announced, users agree to comply with the modified Terms. Therefore, users are requested to review these Terms periodically to ensure awareness of all recent changes. If the user disagrees with Hahow's modifications to the Terms, please exit the Hahow website and cease use of Hahow services immediately. Meanwhile, members shall delete their profiles and terminate their accounts. Hahow Group also has the right to delete the member's profile and terminate the account when the violations listed below occur.
Accounts and Passwords Safety
Whether the user is a visitor or a member, all have access to browse the content published on Hahow, but only users who register as members are eligible to purchase online courses and enjoy the various services provided by Hahow. Visitors can easily create an account on Hahow by entering an email address or using their existing registered Google or Facebook account to log in.
Users are prohibited from using any information unrelated to their true personal data to create an account name, including but not limited to mimicking another person's name, using offensive language, racially discriminatory text, or any text that harms or infringes the rights of others. In such events, Hahow holds the right to terminate the service for that account. When an account has been created but a course has not yet been purchased (after purchasing a product, please follow the Course Purchase Agreement), the following should be noted: Members are responsible for properly safeguarding their accounts and passwords, and shall not transfer or lend their accounts and passwords to others. If a member suspects a security breach or illegal use of their account, they should notify Hahow immediately. Hahow assumes no responsibility for the illegal use of accounts and passwords due to hacking or negligence on the part of the member.
You are responsible for properly safeguarding your account, password, and other related identity verification information, and are fully responsible for all activities and actions taken after logging into the system with this account, including but not limited to any derivative fees.
You agree to comply with all applicable laws when using Hahow and may only use the service for lawful purposes. Using the service or accessing the system using methods other than those approved or instructed by Hahow is strictly prohibited, and Hahow has the right to terminate the service to the user.
Privacy Policy
The personal data provided by users and certain other data related to users kept by Hahow Group is protected and governed under the laws of the Republic of China (Taiwan) and our Privacy Policy.
Terms of Use
Any text, document, video, photo (including photos of users), image, audio, music, creative work, or any other content ("content") uploaded, posted, emailed, or distributed via any other means through Hahow’s services, whether publicly or privately, is the responsibility of the content provider. Hahow assumes no responsibility for any unauthorized content uploaded by members.
Unless expressly permitted by Hahow, users may not download, reproduce, publicly transmit, resell, publicly broadcast, share, or use Hahow and the courses on Hahow. Users who violate the preceding provision shall be responsible for all legal liabilities arising from such infringement.
AI Chat Service
When experiencing the AI chat service, it allows users to submit prompts and chat with the online AI-supported chatbot, which will generate text content in specific situations (hereinafter "Text Works", collectively referred to as "Works" alongside image works).
Users can only use this online service and the generated works in a legal, compliant, and non-infringing manner that does not attempt to or violate the terms of use of this company or any third party (hereinafter defined as "methods", including but not limited to methods, purposes, and/or means that cause or attempt to cause Hahow online services to produce content).
Due to the nature of this online service, works may not be unique among users, and the service may produce the same or similar output for Hahow or other users. Additionally, other users may ask similar questions and receive the same, similar, or different responses. Hahow does not guarantee the authenticity, accuracy, or reproducibility of the content provided through this service.
Pre-order and Course Enrollment
Hahow is a crowdfunding platform for online courses. Hahow allows some members to propose courses and seek pre-orders from other members (pre-orderers). Members who propose courses are course instructors, while pre-orderers or members who purchase the courses are students.
Invoice
Hahow will issue and deliver a payment invoice to students upon the purchase of the course (for both pre-orders and officially launched courses). However, according to the tax regulations of the Republic of China, for students who purchase the course from outside of Taiwan, no invoice shall be issued.
Third Party Links
Hahow may contain links to third-party websites that are external to Hahow. Since Hahow has no control over these websites and resources, users must independently learn about the terms, conditions, and privacy policies of each third-party website before accessing them.
Intellectual Property Rights
Hahow retains all rights, title, and all resulting interests in and to Hahow and all content published on Hahow ("Website Content"), including all copyrights, patents, trade secrets, trademarks, and other intellectual property rights. Any rights not expressly granted herein are reserved solely by Hahow.
All materials and combinations of the Website Content, including but not limited to documents, courses, various images, reports, course introductions, instructor introductions, and FAQs are the copyrighted work of Hahow. Your use of all materials and combinations of the Website Content is governed by these Terms.
The design or layout of Hahow is protected by copyright, design patents, trademark, fair trade, and other laws and may not be copied or imitated in whole or in part. No trademark, design, sound, or image from Hahow may be copied or retransmitted unless expressly permitted by Hahow Group.
Content and Other Legal Rights
Hahow Group is not the owner of all content uploaded to Hahow. However, when members and users publish, upload, or submit content to the Hahow website or platform (including but not limited to comment sections, course reviews, Q&A discussions, and assignment submission areas), the member agrees to grant Hahow Group a worldwide, irrevocable, non-exclusive, royalty-free license to reproduce, use, publish, translate, publicly display, publicly transmit, publicly broadcast, and adapt the aforementioned content across all existing or future media platforms. The member agrees that no compensation will be paid with respect to the aforementioned use.
Termination of Service
The user agrees that Hahow Group has the right to terminate or suspend the member's use of Hahow platform services at any time, based on its judgment or for any reason, including but not limited to infrequent use of the service or violation of these Terms. The termination of course-related services for members who have already purchased courses will be governed by the Course Purchase Agreement.
Upon termination of service, with or without notice, Hahow Group may delete the member's account and content, and prevent the user from future access to or use of Hahow.
Indemnification
The user warrants to indemnify and hold harmless Hahow Group and its management, directors, employees, agents, and contractors from and against any claims, demands, losses, liabilities, damages, or expenses (including but not limited to reasonable attorney fees) arising from (a) the content the user posts or submits, (b) the use of Hahow, (c) the user’s violation of these Terms, or (d) the user’s violation of any rights of a third party.
Hahow Group's liability for damages to the user regarding Hahow, whether arising in default, warranty, unjust enrichment, tort, or other liabilities for damages, is limited to the actual, normal, and direct damages incurred. Furthermore, the total compensation is limited to the amount paid by the user for paid services at the time the cause of damage occurred (if no paid services were purchased, it is limited to NT$1,000). However, this limitation does not apply to damages caused by the intent or gross negligence of Hahow Group, its representatives, or its employees.
Data Backup
The user agrees to back up their data at all times to prevent data loss. Hahow assumes no responsibility for any loss of content and the related damages suffered by the user as a result.
Advertisements and Promotions
The user understands that all sales information, such as advertisement content, marketing text, and product descriptions placed on Hahow, are posted by the respective advertisers or product/service providers. Hahow only accepts commissions for posting and does not conduct substantive reviews or modifications of the content. Users are advised to carefully exercise their own judgment regarding the accuracy and reliability of such advertisements. Unless laws and regulations explicitly require Hahow to bear responsibility, Hahow shall not be held responsible for any loss or damage incurred as a result of transactions arising from the aforementioned advertisements.
Prohibited Behavior
The user agrees not to conduct any of the following while using Hahow: (a) modify, reproduce, perform reverse engineering, disassemble, or make any attempt to obtain the source code or content of any function or program; (b) include any commercial or product placement marketing content in published course content. Hahow has the right to independently identify and unconditionally take down or remove content that violates these regulations.
Disclaimers of Warranty and Guarantees
Hahow does not warrant the following: (a) the service will meet the user's specific requirements; (b) any products, services, information, or other courses purchased or obtained on Hahow will meet the user's expectations.
The amounts represented by the Money Points provided by Hahow have been deposited into a trust account opened at a financial institution. The guarantee period is one year from the date of sale. After the guarantee period expires, the Money Point holder may still legally request Hahow to provide services. The trust account is established by Hahow to protect consumer rights, by entrusting all prepayments made by consumers under Hahow's name to a financial institution for a specific purpose. "Specific purpose" refers to its use for Hahow to fulfill its obligation to provide services. The beneficiary of the trust is, in principle, Hahow and not the consumer; however, if conditions stipulated in the trust agreement occur, Hahow will handle the trust property with the financial institution according to the trust agreement to safeguard consumer rights. General Clause
These Terms and the relationship between the user and Hahow shall be governed by the laws of the Republic of China. For any disputes arising between the user and Hahow regarding the service, these Terms, or other related matters, the Taiwan Taipei District Court shall be the court of first instance jurisdiction. If any provision of these Terms is invalid due to a conflict with the laws of the Republic of China, the other provisions of these Terms shall remain in full force and effect. The titles of these Terms are for convenience only and do not have any legal or contractual effect.
